These Terms of Use ("Terms") are a binding agreement between you and Ally Home Services ("Ally," "we," "us"). They govern your access to and use of the Ally website, applications, and services (together, the "Platform").
Acceptance of Terms
You agree to these Terms by using the Platform, submitting a service request, creating an account, accepting a quote, or making a payment. If you do not agree, please do not use the Platform. If you are using the Platform on behalf of another person or entity, you represent that you are authorized to accept these Terms on their behalf.
Ally's Role
Ally is a managed home-services platform and concierge coordinator. To be clear about what that means:
- Ally is not necessarily the direct provider of all services advertised on the Platform.
- Services may be performed by Ally-approved independent service providers.
- Ally does not employ independent providers unless a separate written agreement expressly says otherwise.
- Ally may coordinate requests, review pricing, facilitate communication, process payments, monitor customer experience, and support dispute resolution.
See our Service Provider Disclosure for a plain-language summary of this relationship.
Independent Service Providers
Independent service providers introduced through Ally are responsible for:
- Workmanship
- Labor
- Materials, unless otherwise stated
- Jobsite safety
- Tools and equipment
- Insurance
- Applicable licenses
- Permits and inspections
- Their employees, helpers, subcontractors, and agents
- Compliance with applicable federal, state, county, and municipal laws
Service Requests and Quotes
- A quote is not final until it is accepted by you and confirmed by Ally or the assigned provider.
- Pricing may change if the scope changes, hidden conditions are discovered, site access is limited, customer-provided information is inaccurate, or additional materials or labor are required.
- Ally may provide estimated pricing, pricing bands, or pricing confidence ranges. These are planning aids and are not binding final prices unless expressly confirmed.
Payment Terms
Ally uses a hybrid payment model that scales with project size. Funds are processed by Ally or Ally's payment processor, and release to the provider is coordinated through the Platform.
Projects under $750
- You may be required to pay upfront before scheduling or dispatch.
- Funds are processed by Ally or Ally's payment processor.
- Release to the provider may occur after service completion, customer confirmation, or expiration of the dispute window.
Projects from $750 to $3,000
- You may be required to pay a deposit before scheduling.
- The remaining balance may be due upon substantial completion, final completion, or customer approval.
- Ally may hold funds securely and release them based on completion confirmation, project milestones, or dispute-resolution procedures.
Projects over $3,000
- Ally may require milestone-based payments.
- Milestones may include deposit, material procurement, start of work, substantial completion, and final completion.
- Payments may be released according to the approved scope, milestone completion, and the dispute window.
Dispute Window
- You must report service issues within {{7}} days after completion.
- If no dispute is submitted within that period, Ally may consider the service accepted and release applicable funds to the provider.
- Emergency, safety, property-damage, or warranty-related concerns may be handled separately and are not necessarily limited by this window.
Cancellations and Rescheduling
You may cancel or reschedule a request subject to fair-notice rules. A trip fee or late-cancellation fee may apply when a provider has already traveled to your property or reserved time that cannot be reused. Providers may also need to reschedule due to weather, availability, material lead times, or safety conditions; Ally will help coordinate a new time when that happens. Specific cancellation terms may be presented with your quote or booking confirmation.
Permits, Licenses, and Regulated Work
- Some work may require permits, licensed professionals, inspections, or government approval.
- Ally may require that certain services be handled only by appropriately licensed or insured providers.
- You may not use Ally to avoid any legal licensing or permitting requirement.
No Off-Platform Circumvention
- Customers and providers may not use Ally to connect and then arrange work in a way that avoids Ally's platform, payment system, fees, or communication rules.
- Off-platform arrangements may void Ally protections and any applicable guarantees.
Warranties and Service Issues
- Any provider workmanship warranty must be stated in the accepted quote or service agreement.
- Ally may assist with issue resolution but is not automatically responsiblefor every provider's workmanship unless required by law or expressly agreed in writing.
- Except as expressly stated, the Platform and services are provided "as is" and "as available" to the fullest extent permitted by law.
Limitation of Liability
To the fullest extent permitted by applicable law, Ally and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of the Platform or the services of any independent provider. To the extent liability cannot be excluded, Ally's total aggregate liability for any claim will not exceed the amounts you paid to Ally for the specific project giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
Indemnification
You agree to indemnify and hold harmless Ally and its affiliates from and against any claims, damages, liabilities, and reasonable expenses (including attorneys' fees) arising out of your breach of these Terms, your misuse of the Platform, or your violation of any law or the rights of a third party. Independent service providers agree to indemnify and hold harmless Ally and customers with respect to the work they perform, including claims arising from their workmanship, jobsite safety, licensing, permitting, insurance, and their employees, subcontractors, and agents.
Governing Law
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules. You and Ally agree to the exclusive jurisdiction and venue of the state and federal courts located in Georgia for any dispute not subject to an alternative resolution process, unless otherwise changed by Ally with notice.
